Please read these Terms and Conditions carefully before using our services. By accessing or using Prabhu Host services, you agree to be bound by these terms.
Terms and Conditions
1. Agreement Acceptance
By accessing and using Prabhu Host services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
2. Service Description
Prabhu Host provides web hosting, domain registration, email hosting, VPS servers, and related internet services. We reserve the right to modify, suspend, or discontinue any service at our discretion with reasonable notice.
3. User Responsibilities
- • Provide accurate and complete registration information
- • Maintain the security of your account credentials
- • Comply with all applicable laws and regulations
- • Use services only for lawful purposes
- • Pay all fees and charges when due
4. Payment Terms
All fees are due in advance and are non-refundable except as specified in our refund policy. Failure to pay may result in service suspension or termination.
- • Payment is due on the billing date specified in your account
- • Late payments may incur additional fees
- • Prices are subject to change with 30 days notice
5. Service Level Agreement
We strive to maintain 99.9% uptime for our hosting services. However, we do not guarantee uninterrupted service due to maintenance, upgrades, or circumstances beyond our control.
6. Data Backup and Security
While we perform regular backups, you are responsible for maintaining your own backups. We implement security measures but cannot guarantee complete protection against all threats.
7. Limitation of Liability
Our liability is limited to the amount paid for services in the preceding 12 months. We are not liable for indirect, consequential, or punitive damages arising from service use or interruption.
8. Account Termination
We may suspend or terminate accounts for violation of these terms, illegal activities, or non-payment. Upon termination:
- • Access to services will be immediately revoked
- • Data may be deleted after 30 days
- • No refunds will be provided for remaining service periods
9. Intellectual Property
You retain ownership of your content, but grant us necessary rights to provide services. Our software, systems, and documentation remain our intellectual property.
10. Changes to Terms
We reserve the right to modify these terms at any time. Significant changes will be communicated via email or account notifications. Continued use of services constitutes acceptance of revised terms.
11. Governing Law
These terms are governed by the laws of Nepal. Any disputes will be resolved through arbitration or in the courts of Kathmandu, Nepal.

13. Service Level Agreement (SLA) & Uptime Guarantee
We aim to provide highly available services with industry-standard uptime. If the server(s) hosting your account experience annual downtime of more than 1%, you may be eligible for compensation if all conditions below are met:
- •The Customer has used our hosting service for at least 12 months.
- •The server(s) experience a total downtime of more than 1% in a 12‑month period after account activation or during any consecutive 12‑month period.
- •Downtime does not include events beyond our reasonable control, including but not limited to: DDoS attacks, upstream Internet connectivity issues, power outages, hardware or software failures, and force majeure (fire, flood, natural disasters, acts of war or terrorism, labor disputes, etc.).
- •The Customer requests compensation no later than 30 days after the relevant 12‑month period ends. Approved compensation is issued as an account credit equal to the hosting fee prorated by the hours of downtime.
14. Inodes Policy
Each file or directory counts as a single inode. For shared hosting accounts, backups (except disaster recovery copies used internally) will not be created once an inode cap is reached.
- •Enterprise: 420,000 inodes
- •Business: 210,000 inodes
- •Starter: 140,000 inodes
Accounts exceeding limits may be asked to reduce usage or upgrade, as high inode counts can degrade performance across the shared environment. Persistent non‑compliance may result in suspension.
15. Backup Policy
We back up accounts with a retention period of 30 days. Backups are provided as a courtesy for internal disaster recovery purposes only and are not guaranteed.
- •The Customer is solely responsible for maintaining their own backups of websites, databases, emails, and other content.
- •We are not liable for any damage or loss of data arising from lack of or outdated backup copies.
- •We are not responsible for the time required by the Customer to restore content.
16. Disk Space & Traffic Usage
“Unlimited” and “unmetered” refer to typical usage for small and home business websites in a shared environment and must not adversely impact server performance or other customers.
- •Cloud hosting resources are provided on a first‑come, first‑served availability basis.
- •Unlimited does not permit online storage, backup/archival of files, distribution of large media libraries, or FTP file serving.
- •Accounts that adversely affect server or network performance may be required to optimize or upgrade.
Unlimited Bandwidth
Shared servers are not hard‑limited on bandwidth but must maintain fair usage. Accounts degrading service quality must remediate or upgrade.
17. Database Usage Policy
Database usage must not endanger overall server performance. We may determine certain queries to be slow or abusive at our discretion.
- •Do not use more than 10% of system resources in any second spent in database queries under the account.
- •Max database sizes per shared plan: Enterprise 900 MB, Business 600 MB, Starter 300 MB.
- •Databases exceeding limits may be suspended, rotated, or terminated.
18. CPU Access Policy & Governance
CPU resources are shared. Each plan facilitates a certain monthly CPU allotment.
- •We may notify you at 70% usage of your monthly CPU allotment to collaborate on optimization or plan changes.
- •If no action is taken, we may temporarily limit CPU access until the monthly quota resets.
19. Providing Technical Support
Support is provided on a commercially reasonable effort, “as‑is” basis. Phone support has limited access; advanced assistance requires a support ticket via the Client Area.
- •We may refuse support where requests are abusive, excessive, unrelated, or create risk.
- •By requesting support, you authorize our access to your account strictly to fulfill the request.
- •Abuse of the ticketing system may lead to warnings, restrictions, or suspension.
20. Server Configuration Policy
We may adjust server configurations, software versions, and modules at any time to improve performance and stability. Activities contradicting server configurations are prohibited.
21. Email Usage & Anti‑Spam Policy
- •IMAP mailbox size limits: Enterprise 750 MB, Business 550 MB, Starter 350 MB; max 10 simultaneous IMAP connections.
- •Outbound sending: up to 400 emails/hour/account. Inbound receiving: up to 80 emails/min across all mailboxes; max 15 recipients per single email.
- •Zero‑tolerance spam policy; violations may lead to suspension pending review.
Email delivery is not guaranteed due to the nature of the Internet. Service is provided on an “as‑is, as‑available” basis.
22. Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including acts of God, civil or military authority, fires, wars, riots, earthquakes, storms, and floods.
23. Enforceability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. We will replace the invalid provision with one that most closely reflects the original intent.
